- GENERAL PROVISIONS
1.1. These Terms and Conditions establish the procedure for manufacturing and selling of goods by individual customer order by VIVONS brand stores.
1.2. If any issues are not covered by these Terms and Conditions, the General Terms and Conditions of Sale of Goods, which are posted on the website http://vivonsofficiel.com/, are applied.
1.3. By placing an individual order, the customer unconditionally agrees to follow these Terms and Conditions and confirms that he/she is familiar with them.
1.4. VIVONS brand stores fulfil individual customer orders of two types:
1.4.1. Manufacturing of clothes, footwear, accessories (further – goods) of the VIVONS brand according to the individual measurements of the client;
1.4.2. Creation and manufacturing of an individual model of goods of the VIVONS brand for the client.
1.5. VIVONS brand stores do not create or manufacture copies of models of other brands.
- ORDERING, EXECUTION OF THE ORDEF AND PAYMENT OF THE ORDER ACCORDING TO THE INDIVIDUAL MEASUREMENTS OF THE CLIENT
2.1. To place an order according to the customer’s individual measurements, the customer contacts the manager of the VIVONS brand store by phone, e-mail, by sending a message via messenger / social networks.
2.2. The customer makes measurements independently and informs them to the manager of the VIVONS brand store. The client is responsible for the correctness of the measurements.
2.3. The customer has a right to choose the fabric, the color of the product from those offered by the store manager of the VIVONS brand.
2.4. The order is deemed to have been duly executed if the customer has provided all the data that allows to identify the customer and contact him:
2.4.1. Full name / name;
2.4.2. Delivery address;
2.4.3. Contact phone;
2.4.4. E-mail address;
2.4.5. Desired payment procedure (payment methods are listed in clause 3.3);
2.4.6. Desired type of delivery of goods.
2.5. The order according to individual measurements begins to be executed after the client makes 100% prepayment for the goods in one of the following ways:
2.5.1. Online with Mastercard / VISA card;
2.5.2. Through the LIQPAY system;
2.5.3. Money transfer Western Union, MoneyGram, Golden Crown (for international delivery);
2.5.4. According to bank details.
2.6. Goods made according to individual measurements are not subject to return or exchange.
2.7. Money paid by the customer as a prepayment for goods made to according individual measurements are non-refundable. The customer has the right to cancel the order according to individual measurements only until the prepayment for such goods is made.
- REGISTRATION, PERFORMANCE AND PAYMENT OF THE ORDER OF THE INDIVIDUAL MODEL OF THE GOODS
3.1. To place an order for an individual model of the goods, the customer contacts the manager of the VIVONS brand store by phone, e-mail, by sending a message via messenger / social networks.
3.2. The order is deemed to have been duly executed if the customer has provided all the data that allows to identify the customer and contact him:
3.2.1. Full name / name;
3.2.2. Delivery address;
3.2.3. Contact phone;
3.2.4. E-mail address;
3.2.5. Desired payment procedure (payment methods are listed in clause 3.3);
3.2.6. Desired type of delivery of goods.
3.3. The order of an individual model of the goods begins to be executed after the client makes a 100% prepayment for the designer’s work and creation of a sketch in one of the following ways:
3.3.1. Online with Mastercard / VISA card;
3.3.2. Through the LIQPAY system;
3.3.3. Money transfer Western Union, MoneyGram, Golden Crown (for international delivery);
3.3.4. According to bank details.
3.4. After making a prepayment in accordance with paragraph 2.3 of these Terms and Conditions, the designer begins to work with the client. The client informs the designer of his wishes about the model of goods, its style, construction, fabric, color, and other elements of appearance. Based on the wishes of the client, the designer creates a sketch. The designer reserves the right to decide by him-/herself what the final look of the goods will be, maintaining the individual style of VIVONS brand goods.
3.5. After discussion, the sketch and description of the goods are approved by the customer. After approval of the sketch, the customer has the right to make three fittings and make three adjustments to the sketch and description of the goods. At the same time complete change of style, a design, other essential elements of model of the goods is not allowed. Adjustments are made to the approved sketch and description of the goods.
3.6. After approval of the sketch and description of the goods, the final cost of the goods is calculated (including the cost of fabric, other materials, work, etc.). The client is obliged to pay the of the final value of the goods in one of the ways specified in clauses 3.3.1.-3.3.4 of these Terms and Conditions. After paying the full final cost, the manufacturing of the goods begins. If in the process of manufacturing of the goods adjustments that require additional costs will be made at the request of the client, the client is obliged to make a prepayment for such adjustments in one of the above ways.
3.7. An individual model of the goods made according to the order of the client, is not subject to return and exchange.
3.8. Money paid by the customer as a prepayment for an individual model of goods made according to the order of the client is non-refundable. A client has a right to cancel such an order only until the prepayment is made.
- DELIVERY OF THE ORDER
4.1. Delivery of goods through the territory of Ukraine is carried out by the delivery service “Nova Poshta” / “Ukrposhta”, by courier to the address specified by the client or by self-pickup.
4.2. Delivery of goods outside the territory of Ukraine is carried out by international delivery services.
4.3. The VIVONS brand store is considered to have fulfilled its obligation to deliver the order at the time of delivery to the delivery service. The risk of death or damage to the goods after they are transferred to the delivery service is borne by the client.
4.4. Separate deliveries of each commodity item with one order are also paid separately.
4.5. The client also pays at his own expense the amount of remittance commissions for the purchased goods, including “Cash on” by the carrier. In order to avoid additional commissions when paying for an order, we recommend a secure form of payment directly on the site through the electronic payment system of PrivatBank.
